✨ Market Law – Professional Development Reminder to Book

Last year NABMA organised two very successful legal seminars that provided an update on various issues relating to market law. They were delivered by Graham Wilson, NABMA’s Legal and Policy Consultant. Following expressions of interest as received a further seminar is now arranged on Monday 13 June – 10.00 – 12.30. Have you booked yet? The  event will have a charge of £75 plus VAT per delegate. This interactive event, delivered by Zoom, will be an opportunity for practical help to learn about, and discuss this most interesting aspect of UK law. The course tutor will again be Graham Wilson OBE, the NABMA Legal and Policy Consultant and co author of the seventh edition of Pease, Chitty and Cousins: Law of Markets and Fairs.   The seminar will cover the main legal framework of market law highlighting the history and the current provisions. There will be an opportunity to consider how case law and legislation impact on your local market situation.  From examining what actually constitutes a market to establishing and operating a market the seminar will cover day to day management issues and relationships with traders and other stakeholders. We will consider in particular how market powers have evolved and how they can be used in a practical way. We will also look at the relationship between Parish and District/Unitary Councils where they each share market powers. Importantly, there will be time for you to raise your individual queries and get help in resolving issues that impact on the running of your market. To book then please email info@nabma.com   David Preston (BA Hons)Chief ExecutiveThe National Association of British Market Authorities

✅ VAT on Market Lettings

The issue of VAT on market lettings continues to be a vexed issue for many of our members. NABMA continues to receive enquiries from members about the status of VAT. In 2019 a Tribunal held that VAT is chargeable on events such as Antique Fairs ( Craft Carnival case) because of the specialist nature of the events and the additional services often associated with such events.  More recently HMRC has tried to extend liability to car boot sales with a large car boot sale near York facing a potential VAT charge of £140,000 because HMRC argued that the arrangements were similar to those that existed in the Craft Carnival case. However the car boot operator was successful in an appeal against VAT on the basis that the arrangements at the car boot sale only involved a simple pitch licence with basic additional services. With regard to traditional Markets NABMA is clear that VAT is not normally chargeable and that traditional Markets do not fit the situation before the 2019 Tribunal. If any members have any concerns about VAT issues at their Market please get in touch. NABMA has taken advice from a leading tax barrister on this issue and a copy of this advice is available to NABMA members. Yours sincerelyDavid Preston (BA Hons)Chief ExecutiveThe National Association of British Market Authorities
